These terms and conditions of sale form the basis of commercial negotiation and are systematically sent or given to each customer to enable them to place an order. Any order by the customer implies acceptance without restriction or reservation of these terms and conditions of sale once they have been communicated to them in accordance with the practices of the profession.
The fact that the customer does not at any given time invoke any of these terms and conditions of sale cannot be interpreted as a waiver of the right to invoke any of those terms at a later date.
The Customer declares having read these general terms of sale when placing the order, and acknowledges that validating the order implies acceptance of their terms without reservation. These terms of sale set out the contractual conditions applying exclusively to any consumer (hereinafter « the Customer »), within the meaning of the preliminary articles of the French Consumer Code, who makes an online purchase on the website www.speed2max.com from the seller named in the « Seller » article (hereinafter « the Service Provider »), and apply only to the services performed for and invoiced to Customers. The Customer further acknowledges that the Terms are made available in a way that allows them to be stored and reproduced, in accordance with article 1127-1 of the French Civil Code.
Seller
The karting services booked on this site are sold and invoiced by the centre that welcomes you, identified on the booking page, on your confirmation and on your invoice. For the Clermont-Ferrand centre, the seller is SARL SYCOMAX (see the legal notice at the end of the document). Shop items and gift cards are sold by SARL SYCOMAX.
1 - Purpose – Scope
The purpose of these general terms of sale is to define the rights and obligations of the Service Provider and the Customer in connection with the sale of services. They apply, without restriction or reservation, to any purchase of karting sessions, gift cards and shop items offered to non-professional Customers on the website www.speed2max.com, published by SARL SYCOMAX, operating the Speed2Max brand.
2 - Orders
2.1 Creating a customer account
To place an order, the customer must first create a personal account containing all the data needed to identify them. The customer acknowledges that all the information concerning them is true and sincere. They undertake to update any data concerning them that would change the data provided when the account was created.
The Service Provider reserves the right to ask for the customer's identity document in order to check the customer's personal data, which the customer accepts, it being specified that any refusal by the customer or any inaccurate information will result in the closure of the account and the cancellation of the order.
The Customer is solely responsible for the use of their account. Any login or transmission of orders or data using their password will be deemed to have been made by them and under their sole responsibility.
2.2 Placing the order
The customer must be of legal age on the day of the order. A minor may take part in a session under the responsibility of an adult who is present, provided they meet the age and height conditions of the chosen package. These conditions are shown on the page of each centre and each package, before booking. Unless otherwise stated, a kart driver must be at least 7 years old, at least 1.30 m tall and weigh no more than 130 kg.
The centre may check age and height at reception and refuse access to the track to a participant who does not meet these conditions.
To finally validate the order, the customer must check the details of their order and the total price, and correct any errors; all these checks are made under their sole responsibility.
After checking the information and the customer's validation of the order, a confirmation email acknowledging receipt of the order and setting out all the information is sent by the Service Provider.
3 - Price
The price of the service is shown excl. VAT and incl. VAT according to the rates in force on the service provider's website applicable on the day the order is placed.
Payment prior to the issue of the QR code is made by the customer in their personal area, using the methods offered to them.
The amount paid online is debited from the bank card when the customer confirms the payment. Gift cards and shop items are paid in full when ordered. For a booking, depending on what the centre offers for the chosen package, the customer pays the whole booking or a deposit online, or pays on site. Any amount still due is paid at the centre or, when the centre allows a group booking to be paid in several shares, through the participants’ shares, under the conditions of the « Group booking paid in several shares » article. Except where the right of withdrawal is exercised under the conditions provided by law, the order is firm and final, so that no refund can be made for any reason other than the one provided for in this article.
4 - Issue of the ticket
Once the order has been finally validated and the price of the service paid, the customer will receive a confirmation email containing a QR code to present at reception to access the circuit and for the Service Provider to perform the service.
If the QR code is not presented, the service provider will check the customer's identity to allow them access to the circuit. The QR code is only valid for the day and time slot booked by the customer when ordering.
5 - Right of withdrawal
5.1 Sessions and activities on a fixed date
In accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to bookings of karting sessions and events, which are leisure activities provided on a specific date or during a specific period. The cancellation conditions of each package (5.4) remain applicable.
5.2 Gift cards and shop items
The Customer has fourteen days to withdraw, without having to give reasons (Article L221-18). This period runs from the conclusion of the contract for a digital gift card, and from receipt for a delivered item. The day of conclusion or receipt is not counted; a period that ends on a Saturday, a Sunday, a public holiday or a non-working day is extended to the next working day (Article L221-19).
The seller refunds all sums paid, including the initial delivery costs, no later than fourteen days after being informed of the withdrawal, using the same means of payment as for the order (Article L221-24). For a delivered item, the refund may be withheld until the item has been recovered or until the Customer has supplied proof of having sent it back.
The Customer returns the item without undue delay and at the latest fourteen days after withdrawing; the cost of return is borne by the Customer.
5.3 How to withdraw
The Customer may withdraw online, free of charge and throughout the withdrawal period, by means of the link Withdraw from contract here at the bottom of every page of the website, or from each order in the customer area. The Customer gives their name, the e-mail address used for the order and the order reference, then confirms the withdrawal. An acknowledgement of receipt repeating the content of the statement and the date and time it was sent is e-mailed to the Customer without delay.
The Customer may also withdraw by means of the form in the annex, or by any other unambiguous statement sent to the seller (Article L221-21).
5.4 Cancelling a booking
A booking can be cancelled from the customer area up to 48 hours before the start of the session: everything paid online is then refunded automatically to the card used. After that, online cancellation is no longer possible; the Customer contacts the centre, and the cancellation conditions of the package, shown before payment, apply.
6 - Liability of the Service Provider – Warranty
6.1 Liability of the Service Provider
Except in cases of force majeure, should it be impossible to perform the service on the days and at the times booked, the Service Provider will refund or book another time slot on a date agreed with the Customer. The refund will be made by credit to the Customer's bank account. The Service Provider's warranty is limited to the refund of the services actually paid for by the Customer.
6.2 Exemption from liability of the Service Provider
The Service Provider cannot be held liable or in default for any delay or non-performance resulting from a case of force majeure preventing or suspending the provision of services (an irresistible and unforeseeable event such as a power grid failure, etc.). The Service Provider cannot be held liable for damage resulting from the Customer's misuse of the equipment and material made available to them, or if they leave personal belongings in their locker.
7 - Service
7.1 - For the performance of the service, the customer must arrive 30 minutes before the day and time of their booking so that they can be identified and read the safety rules displayed at reception. Access to the circuit constitutes the customer's acknowledgement of the safety rules with which they must strictly comply and which have been brought to their attention.
The customer undertakes to use the equipment made available to them in accordance with the safety rules of which they have taken note and which they have accepted.
The Customer declares that they are fit to drive (not pregnant, not suffering from any physical or mental impairment) and in good health. The Service Provider reserves the right to refuse access, for safety reasons, to persons who are drunk, under the influence of drugs or amphetamines, or aggressive. Any minor must be accompanied by an adult and meet the conditions set out in Article 2.2.
The Service Provider reserves the right to exclude from a session, without any refund, anyone who does not comply with the safety rules or who behaves discourteously.
7.2 - Nature of the Service
The Service Provider provides the customer with a kart and access to the circuit on the day and at the time specified in the order.
7.3 - Ownership of the equipment and material belonging to Speed2Max
The provision of services by the Service Provider gives the Customer only a temporary right of use, conditional on compliance with the safety rules, over all the equipment, material and means needed to deliver them, such as karts, clothing, helmets, etc.
7.4 - Conditions for the provision of karts
Karts will be made available on condition that each Customer has taken note of the track rules by watching the safety video in the changing room and reading the safety instructions on the notice boards.
8 – Insurance
8.1 Service Provider's insurance
The Service Provider holds professional liability insurance with MMA IARD Assurances Mutuelles for damage that may be caused to the Customer in the course of performing the service.
8.2 Customer's insurance
The Customer undertakes to check that their civil liability insurance covers them for any material and non-material damage that may be caused to third parties throughout their presence on the service provider's premises.
9 - Protection of personal data
The Customer's personal data is processed by the seller of the service, as data controller, for the management of the order or booking, on the basis of the contract and its legal obligations. Its processing is described in the privacy policy, which sets out the recipients, the retention periods and the Customer's rights (access, rectification, erasure, restriction, objection, portability, post-mortem directives). These rights are exercised by e-mail to contact@speed2max.com or by post to SARL SYCOMAX, 160, avenue Jean-Mermoz, 63100 Clermont-Ferrand. The Customer may lodge a complaint with the CNIL (www.cnil.fr).
10 - Applicable law - Jurisdiction - Disputes
These terms and conditions are governed by French law.
In the event of a difficulty, the Customer may send a written complaint to the seller, at the contact details given in the legal notice. The seller endeavours to reply within one month.
In accordance with Articles L612-1 et seq. of the French Consumer Code, if the complaint is unsuccessful, the Customer may have free recourse to the consumer mediator to whom the seller is subject: CM2C, https://cm2c.net. Mediation may only be initiated after a prior written complaint to the seller, and within one year following it.
The mediator's postal address will be given here as soon as the membership certificate is received.
Failing agreement, the Customer may bring the matter, at their choice, before the court of the place where they lived when the contract was concluded or when the harmful event occurred, or any other court having jurisdiction under the French Code of Civil Procedure.
Additional clauses
Group booking paid in several shares
Where the centre allows a group booking to be paid in several shares, the person making the booking remains liable to the seller for the total price of the booking. Shares that participants have not paid by the end of the session are invoiced to that person. They may be debited from the stored card under the conditions of the article “Storing the bank card”; a receipt is then sent to them by e-mail. If the debit fails, a payment link is sent to them.
Storing the bank card
Where the centre allows a booking to be paid in several shares and an amount remains to be paid after the payment by the person making the booking, that person expressly authorises the seller, by ticking the box provided for that purpose, to have their card stored by the payment provider Sogecommerce (Société Générale). This authorisation allows the amounts still due for the booking after the session to be debited (unpaid shares, previous article). It allows no other debit. A booking paid in full does not store any card.
Card data is held by the payment provider. The seller receives only a technical identifier and the last four digits of the card, which do not allow its number to be reconstructed.
The stored card is deleted at the provider 30 days after the session, or earlier on simple request to contact@speed2max.com.
Gift cards
Gift cards are offered for an amount of 20, 50 or 100 euros incl. VAT. They are delivered in digital form: a PDF file sent to the buyer's e-mail address.
A gift card is valid for twelve months from its purchase; its expiry date is shown on the card. It can be used in one or several instalments, in all Speed2Max centres, to pay for karting services (sessions, packs, packages); the remaining balance is kept until that date. It cannot be used on the online shop.
A gift card is neither refundable nor exchangeable for cash, subject to the right of withdrawal (article 5). The balance unused on the expiry date is lost. When a service paid for with a gift card is refunded, the amount is credited back to the card.
The cardholder is solely responsible for keeping the card safe: a card that is lost or whose code has been disclosed is not replaced.
